Child Support Gold-Diggers
Carey Roberts writes about paternity fraud, for example: “Consider the paternity scam. Here’s how it works: Find any dim-witted man to get you pregnant. Then look up the name of some unsuspecting Joe who’s got a steady job – it doesn’t matter that you never met the poor bloke. Put his name on the baby’s [...]
Challenges of the Adoption Process
Adoption can be very difficult for all parties involved. Of course everyone’s main interest should be the child, but there are times when things just don’t go the way you might think. For example, when a child is placed in a foster home what happens when the child gets attached? I know of woman who [...]
Child Custody
Child custody typically refers to custodial awards or determinations involving a minor child. This often follows a divorce. Normally the state statue regarding child custody is written so that if the couple has children together while married, they have joint guardianship over that child and the parental rights are equal. Each parent has an equal [...]

As a criminal offense, domestic violence usually is charged as a misdemeanor, with a presumption of supervised release on a first offense. Cases that involve serious injury or repeat offenses will usually expose the defendant to harsher penalties. In a family law situation, however, domestic violence is often alleged by one of the parties to the marriage against the other on an ex parte basis--that means that the person accused of domestic violence is not notified of the charges until the court issues a protective order.

A protective order can cover behavior other than domestic violence or assaultive behavior. Stalking, harassment, intimidation, or other unwanted contact can also be restrained by the court with further incidents punished as a violation of a domestic violence protective order.
The person bound by the domestic violence protective order can bring the case on for a full hearing within 30 days of the initial application. The court will sometimes modify the terms of the protective order, or withdraw it altogether, depending on the facts that are shown at the hearing.
In a divorce or paternity case, it is extremely important for the person bound by the terms of a protective order to make sure that his or her side of the story is presented in court. If a parent has a protective order outstanding against him or her, the parent's right to physical custody of the child will be seriously undermined, and there's even a chance that parenting time will be allowed only on a supervised basis.
At the Law Offices of Tony Zirkle, we can review and evaluate the circumstances of your case to make sure that your side of the story is presented as fully and persuasively as possible. Otherwise, your interests as a parent could be jeopardized. For further information about your rights in a domestic violence situation or the effect of a protective order either in your favor or against you, contact Indiana family law attorney Tony Zirkle at any of our four offices around the state.
