Most disputed issues in divorce are resolved by agreement. From the very beginning of the case, our family law team can explain and work toward the short-term arrangements for custody of the children, visitation and parenting time for the spouse moving out of the marital home, payment of bills and support for the children and if necessary an unemployed spouse, and other matters that need to be resolved within the first 21 days after the divorce case is filed. If the parties cannot agree to these interim arrangements, the family law judge is likely to order temporary custody and support terms that will satisfy neither party.
Once the temporary arrangements have been approved or imposed by the court, we then concentrate on defining the issues that will most likely be contested, whether they concern the division of marital property, the amount of child support payments, or the establishment of a parenting time schedule. In some Indiana counties, mediation of disputed issues is required before the court will hear a motion to resolve a disagreement in favor of one or the other divorcing spouse. In other counties, the judges will hear and resolve disputed issues without the need for mediation.
